Rubbish Clearance Holland Park Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Clearance Holland Park provides rubbish removal and waste collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Service means the rubbish clearance, waste collection, bulky item removal, garden waste removal, or related services we agree to provide.

We, us, our means Rubbish Clearance Holland Park, the provider of the Service.

You, your, customer means the person, company, or organisation requesting and responsible for paying for the Service.

Service address means the property or location at which the Service is to be provided.

Waste means the items, materials, or rubbish to be collected and removed as part of the Service.

2. Scope of Service

We provide on-demand and scheduled rubbish clearance and waste removal services within our service area, including the Holland Park area and surrounding locations. The precise scope of the Service will be agreed at the time of booking, based on the information you provide about the type and volume of Waste and the access to the Service address.

Our Service generally includes loading your Waste from accessible areas of the Service address onto our vehicle, transporting it to a licensed waste facility, and arranging for disposal or recycling in accordance with applicable waste regulations.

Services may include, without limitation, household rubbish removal, office and commercial waste clearance, garden waste disposal, light construction waste removal, bulky item collection, and similar waste-related services. We do not provide skip hire, demolition, or any services not expressly agreed at the time of booking.

3. Booking Process

You may request a booking by telephone, email, online contact form, or any other method we make available. When making a booking, you must provide accurate details, including your name, contact information, Service address, description and approximate volume or weight of the Waste, and any relevant access or parking information.

Any quotation provided before we arrive at the Service address is an estimate only, based on the information you supply. The final price may be adjusted if the actual volume, weight, type of Waste, or access conditions are different from those described at the time of booking.

A booking is only confirmed when we expressly accept it and provide you with a time and date for the Service. We will make reasonable efforts to arrive within the agreed time window, but all times are estimates and may be affected by traffic, weather, and other circumstances beyond our control.

4. Access and Customer Responsibilities

You are responsible for ensuring safe, reasonable, and lawful access to the Service address for our staff and vehicle. This includes arranging any necessary parking permissions or permits and providing accurate information about access restrictions such as height limits, narrow roads, security gates, or restricted zones.

All Waste to be collected should be safely accessible and, unless otherwise agreed, located on the ground floor or outside the property. If our team is required to collect items from higher floors, confined spaces, or areas with restricted access, additional time and charges may apply or the Service may not be possible.

You must ensure that the Waste does not contain any prohibited, hazardous, or dangerous materials that you have not declared in advance. You are responsible for securing pets and ensuring that children and other occupants are kept at a safe distance while the Service is being carried out.

5. Waste Types and Prohibited Items

We can collect a broad range of non-hazardous waste, including general household rubbish, furniture, appliances, garden waste, and light building debris, subject to local regulations and facility acceptance.

We do not normally collect or transport hazardous or specialist materials, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuel, gas cylinders, pressurised containers, explosives, paint in liquid form, or any other materials classified as hazardous under applicable law, unless previously agreed in writing and arranged with appropriate facilities.

If hazardous or prohibited items are discovered among the Waste, we may refuse to collect them, adjust the price, or cancel the Service. You will be responsible for any additional costs, delays, or regulatory issues caused by undisclosed hazardous or prohibited items.

6. Pricing and Quotations

Our pricing is typically based on the estimated volume and weight of the Waste, the labour involved in loading, the type of materials, and any additional factors such as difficult access, stair work, or parking charges.

Any quotation provided prior to our team viewing the Waste is an estimate and not a fixed price. Upon arrival, our staff will assess the Waste and confirm the final price before commencing the Service. If you decline the revised price, a call-out or minimum charge may apply to cover our costs.

Where we provide a fixed price in advance based on detailed information, photographs, or a site visit, that price will only remain valid if the description of the Waste and access conditions remains accurate. Material changes may result in a revised quotation.

7. Payments and Invoices

Payment is due on completion of the Service, unless we have agreed different credit terms in writing before the Service date. We may accept payment by cash, card, bank transfer, or other methods that we notify to you.

We reserve the right to require a deposit or full prepayment, particularly for large or commercial clearances. Any such requirement will be communicated to you at the time of booking.

Where invoices are issued on credit terms, payment must be made in full by the due date stated on the invoice. If payment is late, we may charge interest, late payment fees, and recover reasonable costs of debt collection as permitted by law.

8. Cancellations and Amendments

You may cancel or amend your booking by contacting us during our normal business hours. We request as much notice as possible so that we can reallocate resources.

If you cancel more than 24 hours before the scheduled Service time, no cancellation fee will normally apply. If you cancel within 24 hours of the scheduled time, we reserve the right to charge a reasonable cancellation fee or retain any deposit paid to cover our costs.

If our team attends the Service address at the agreed time and is unable to carry out the Service for reasons within your control, including lack of access, incorrect address details, or refusal of the revised price where the details provided were materially inaccurate, we may charge an attendance or call-out fee.

We may cancel or reschedule the Service due to circumstances beyond our control, including but not limited to vehicle breakdown, staff illness, severe weather, or regulatory restrictions. In such cases, we will notify you as soon as reasonably possible and offer an alternative appointment. We will not be liable for any loss arising from such cancellation or rescheduling, other than refunding any prepayments for Services not delivered.

9. Performance of the Service

Our staff will perform the Service with reasonable care and skill. You or your representative should be present at the Service address during the collection to confirm the Waste to be removed and to review the area upon completion.

We will use reasonable efforts to avoid damage to property when carrying out the Service. However, you are responsible for protecting floors, walls, and fixtures, and for moving or securing any fragile or valuable items that may be at risk during the removal process.

Our responsibility is limited to the areas we reasonably need to access to carry out the Service. We are not responsible for pre-existing damage or defects, nor for wear and tear that becomes apparent as a result of moving items.

10. Title to Waste and Documentation

Once the Waste has been loaded onto our vehicle and payment has been made in accordance with these Terms and Conditions, title and responsibility for the Waste transfers to us. We will then manage transportation and disposal at licensed facilities in line with applicable UK waste regulations.

Where requested and applicable, we will provide a waste transfer note or other standard documentation to confirm that the Waste has been collected and is being processed in accordance with relevant regulations.

11. Compliance with Waste Regulations

We operate under relevant UK waste legislation and duty of care requirements, including using appropriately licensed disposal and recycling sites. We take reasonable steps to maximise reuse and recycling where facilities and materials permit.

You confirm that you have the authority to arrange removal of the Waste from the Service address and that the Waste is not stolen, unlawfully obtained, or otherwise in breach of any legal or contractual obligation.

You must not request us to dispose of Waste in any unlawful manner. We will refuse any request that conflicts with applicable waste regulations or environmental standards.

12. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded or restricted by law.

Subject to the above, our total liability to you arising out of or in connection with the Service, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable by you for the specific Service giving rise to the claim.

We are not liable for any indirect, consequential, or special loss, including loss of profit, loss of business, or loss of opportunity, arising from or in connection with the Service or these Terms and Conditions.

We will not be liable for any delay or failure to perform our obligations where such delay or failure is due to events or circumstances beyond our reasonable control, including but not limited to accidents, extreme weather, traffic disruptions, strikes, or regulatory changes.

13. Complaints

If you are dissatisfied with any aspect of the Service, you should raise the issue with our team at the time of the Service where possible, so that we have an opportunity to address your concerns immediately.

If the issue cannot be resolved on site, you should contact us in writing as soon as reasonably practicable, providing your name, contact details, Service address, date of Service, and a clear description of the complaint. We will investigate and respond within a reasonable time frame.

14. Data Protection and Privacy

We collect and process personal information required to manage your booking, provide the Service, issue invoices, and communicate with you. This may include your name, contact details, Service address, and payment information.

We will handle your personal information in accordance with applicable data protection laws and use it only for legitimate business purposes, such as providing the Service, handling enquiries and complaints, complying with legal obligations, and improving our operations.

15. Variation of Terms

We may update or vary these Terms and Conditions from time to time. Any changes will apply to bookings made after the date on which the revised Terms and Conditions are published or communicated. The Terms and Conditions that apply to your booking are those in force at the time you confirm your booking.

16. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings or arrangements, whether written or oral.

18. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Service, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.

19. Contact Details
